TRADEMARK POLICIES

Trademark usage falls into four general categories: commercial promotions on internet sites, sponsored events, off-campus commercial advertising, and photographs or illustrations of the University of Denver. A guide to usage is below.

For all applicable policies listed below, if related to athletics promotion, approval is granted through Athletics Department:

Requests for approval shall be communicated in writing. The University may require that such promotions operate under a promotional license, which would be issued by DU's licensing agent.

COMMERCIAL PROMOTIONS ON INTERNET SITES
The use of DU trademarks in conjunction with a commercial promotion including a commercial internet site may be permissible if the following criteria are met:

  • The promotion or use must be beneficial to DU. This benefit may be tangible or intangible.
  • The use must be consistent with the university's institutional mission, values and standards of excellence.
  • The use must be consistent with all other provisions of this policy.

SPONSORED EVENTS
When a Denver team is an invited participant in an event where the event sponsor's trademarks are used to name the event, DU allows the use of its trademarks in conjunction with the sponsor/event trademarks to promote the event.

OFF-CAMPUS COMMERCIAL ADVERTISING

  • The use of DU's trademarks within advertisements in various media — including, but not limited to, television, radio, print and the internet — may be permissible if the following criteria are met:
  • The advertisement promotes the sale of officially licensed DU merchandise.
  • The advertisement does not state or imply any University endorsement of the company or its products.
  • The advertisement artwork is approved in writing by DU prior to publication and complies with any other requirements imposed by the administrator.

PHOTOGRAPHS OR ILLUSTRATIONS OF THE UNIVERSITY OF DENVER
The use of photographs or illustrations depicting the University of Denver depends on several factors, which are detailed below. A license agreement is required and royalties are due if:

  • The picture or illustration is used as a graphic decoration on a commercial product.
  • The packaging or advertisement for the product that contains or carries a photograph or illustration is presented in a manner that implies affiliation or association with DU.
  • DU's trademarks (including the name "Denver") appear on any packaging or promotional materials and/or announcements that promote the merchandising of the product.

A license agreement is NOT required and NO royalties are due if:

  • The photograph or illustration is for noncommercial (in-home) use.
  • The photograph or illustration is to be used in a commercial establishment as decoration, but only in a manner that would not imply an affiliation with, endorsement by or association with the University of Denver.
  • The photograph or illustration is being used by a recognized newsgathering service for publication or broadcast.
  • The photograph or illustration is being used in a historical context by a recognized news agency, publisher or other service.
  • The photograph or illustration is used in an entertainment or artistic context, such as commercial movies or TV shows. Trademarks and Licensing must receive written requests for this use and will forward them to the Vice Chancellor for Marketing & Communications for approval.


COMMERCIAL PRODUCT DESIGN APPROVALS
Trademarks and Licensing reserves the right to approve each use of its trademarks on a per-product, per-design basis. Licensees, or those given permission, will submit each proposed use, product, or design to our office or to Denver's authorized agent (for commercial products) for approval. If the product in question is not a University-related product, Trademarks and Licensing will NOT approve the use of its trademarks on the following products:

  • Tobacco or tobacco-containing products
  • Legally controlled substances
  • Sexually oriented products or designs
  • Religiously affiliated products or designs
  • Political products or designs


For purposes of this policy, a "University-related product" is a product, such as a t-shirt, which is the subject of a written license between the University and the licensee-producer that:

  • Is designed to advance some aspect of the University's academic, research or engagement mission.
  • Requires adherence to branding guidelines maintained by the University.
  • Generates proceeds for the University.


In addition, our office will NOT approve:

  • Use of DU's trademarks in text or graphics that are judged to be sexually suggestive; denigrate any groups, including another college or university; or infringe on the rights of other trademark owners.
  • Products that do not, in our office's sole discretion, meet minimum standards of quality and/or good taste or those that are judged to be dangerous or carry high product liability risks.
  • Use of DU trademarks on any product or design that, in our office's sole discretion, may violate NCAA rules. This applies to product designs incorporating:
    •     Jersey numbers, except on authentic or replica merchandise
    •     Photos or any other likeness of a current student-athlete
    •     Names of student-athletes
    •     Nicknames of student-athletes


Trademarks and Licensing approves products or designs incorporating its current trademarks. Trademarks that are obsolete or replaced by updated trademarks continue to be protected and owned by the University of Denver.

ROYALTIES
All licensed goods and services for sale to the public are subject to a royalty. The royalty rate is determined by DU and is subject to change by the University. Trademarks and Licensing or DU's authorized licensing agent are the administrators of this royalty policy.

Our office may grant exemptions from royalty payments on a case-by-case basis. Items purchased by DU for its use ("internal consumption") may be granted exemption if can show they will be receiving a discount from quoted price. This includes items that are given away by DU departments. Any items sold for a fundraising purpose will not be granted an exemption. Regardless, only licensed vendors may produce items with DU licensed marks upon them.
